Frequently asked questions

Who pays transfer duty?

The buyer pays it. Your conveyancing attorney collects it and pays it to SARS before transfer.

Is there transfer duty on properties under R1.21 million?

No. For 2026/27, properties up to R1 210 000 are exempt from transfer duty, although you'll still pay legal and registration costs.

Do I pay transfer duty on a new development?

Not if the seller is a VAT-registered developer selling in the course of their business. The price then includes VAT instead.
